Spring 2011 ACC News

The Architectural Control Committee has been extremely busy this month! That is a good thing. This means that many of our residents are reinvesting in their homes. Many homeowners are adding outdoor kitchens, pools, patios, and room additions. Some are replacing siding and windows. Whatever the project, it tells us that we are proud of our neighborhood and want to keep it and our homes updated.

The AC Committee made a decision and took it to the board for approval. We are allowing residents to stain their fences with one (1) approved stain. This stain is a Semi-Transparent stain available at Sherwin Williams. The stain name is Woodridge and the number is SW3504. This is the only approved fence stain for all of Memorial Northwest. Any other stain or paint is still against deed restrictions and, if used, will result in costly removal on your part. Please note that you only have permission to stain YOUR fence.

It seems that spring has sprung and we are already well on our way to summer! Please take an opportunity to walk around your home and check that all of your plants survived the winter. I even had to replace a couple of sprinkler heads due to the past freeze. Spring cleanup and replanting can be a chore but gratifying all the same.

Also with warm weather comes vacations and visitors. Please be aware our deed restrictions contain very definite language about parking RVs in the subdivision. The restriction basically states as follows: Boats, campers, trailers and motor homes must be stored in such a manner that they are NOT VISIBLE FROM ANY STREET. Parking for more than sixty (60) cumulative hours out of any seventy-two (72) hour period is considered a violation. Please help us by abiding by the deed restriction concerning RV parking and make arrangements for appropriate storage before your guests arrive.

Please remember that any architectural changes made on your property require prior approval from your AC Committee. You may download the application from our website or you may pick it up at our Community Center between the hours of 9 a.m. until 3 p.m.

When to Submit an Architectural Control Application

ACC applications are required for any outside (front or backyard) changes.

For example, if you are replacing windows, siding, or hardi-plank, you must fill out an application. All outdoor painting requires an application with paint samples with approval before starting the job. Moving or expanding any fencing requires an ACC application. Additions of any kind, attached or not, require an application. This includes, but is not limited to, play equipment, pools, spas, storage buildings, patio covers, etc. All new roofs require an ACC roof application. Approved shingles can be found listed on the roofing form.

All forms may be found at the MNW Community Center office on Theiss Mail Route or downloaded from our website at  www.mnwcenter.com. They may also be downloaded from Consolidated Management Services at www.cmsgroup.org  . After completing the application, you may mail, email, or fax the application to our management company:

Our management company reviews the application and then sends it to me, your ACC chairperson. My committee reviews the application and makes an appointment with you, the homeowner. We then meet and go over with you any deed restrictions that apply to your specific job. Please note that after you submit your application the ACC committee has 30 days to respond. (Our average timespan is seven days. After approval, you have 90 days to complete the job. If the job scope changes or takes longer than expected, the ACC committee should be notified and we will work with you.

Please remember to submit all information needed for each job. ANY type of additions requires a copy of your plat. Failure to submit a completed application will result in your application being returned to you, delaying your start date. STARTING AND/OR FINISHING AN IMPROVEMENT JOB WITHOUT ACC APPROVAL WILL RESULT IN YOUR RECEIVING A CEASE-AND-DESIST LETTER. This can be very costly for the homeowner. For example, if you paint your home before approval, you will likely have to endure the cost of repainting if your color is not approved. If you build a patio cover, you may have to remove it due to a deed restriction violation.

We have 23 different sections in this neighborhood. Each section has its own deed restrictions. So what is okay for one neighbor may not be for another. The ACC committee is here to help you. We work with you to ensure you achieve your wants, wishes, and needs while making sure restrictions are not violated. Neighbors may agree to “fudge the propert. lines” or “equally agree to disputing overhangs,” but deed restrictions trump neighborly agreements.

Please protect yourselves, time, and pocketbooks by filling out an ACC application and getting approval before you start the job. If you are starting a project and you are still not sure whether or not you need ACC approval, please contact me with any questions.

ARCHITECTURAL CONTROL GUIDELINES

If you are planning any home construction or visible improvements, (roofing,
exterior paint color, remodeling additions, children's play equipment, pools,
storage facilities, etc.)  please remember to request architectural control approval prior to beginning any job. IF UNAPPROVED WORK IS IN PROGRESS OR COMPLETED THAT DOES NOT MEET GUIDELINES, YOU WILL BE ASKED TO REMOVE THE STRUCTURE OR CORRECT IT TO ACHIEVE COMPLIANCE.

The function of the Architectural Control Committee (ACC) is to protect the
value of our subdivision and our home investments.

The ACC has 30 days to review and respond to requests, so please remember
to plan for this early. New roof requests ONLY are handled on a weekly basis
if the form included on this site/or newsletter is used.

For most projects you will need to provide:

  • Site plan showing proposed expansion and easement lines
  • Detailed elevation plans
  • Proposed construction materials and finishes

Unless otherwise stated all work must be completed within 90 days from start.
Contractors advertisement signs are against deed restrictions.
